ISEVA LIMITED (ISEVA) provides web development, website design, hosting and domain registration.
All charges are payable in advance from the setup date following the billing cycle either annually or monthly. The customer must ensure their credit/debit card details are correct or authorised for use if a company card.
Customers are also responsible for providing ISEVA with changes to billing information (such as credit card expiration, change in billing address). None payment may result suspension or termination of services.
Domains are registered or transferred after payment. We can not guarantee availability after payment.
Prices do not include VAT which is applied at checkout depending region.
Termination of services must be done by email or writing prior to renewal date.
All charges are non-refundable unless otherwise stated.
After domain is registered or transfer, any charges are non-refundable.
Refunds on services are given 14 days after purchase except domain registration, software (plugins/modules) purchased in relation to web development, email hosting.
Use of Service
Customer agrees to use the service in compliance with applicable law and ISEVA's Acceptable Use Policy. Disregarding the AUP will result in suspension or termination.
All works produced by ISEVA remains the intellectual property of ISEVA unless otherwise stated. For discounted services or solutions all code and artwork remains the intellectual property of ISEVA in which case the client agrees to host their website or service on the ISEVA server. For works in development, the source code and all associated assets are the property of ISEVA. Upon full payment and completion of works the client has intellectual property right of website assets (except discounted services).
Customer privacy is important to ISEVA and therefore details will not be shared with others except internally. We may periodically send email regarding new services and offers.
If in violation of the AUP, customer agrees ISEVA will not be liable for any loss of service, trade or profit. ISEVA will take reasonable measure to reinstate the service when customer meets the AUP for which there may be a fee.
Customer agrees to indemnify and hold harmless ISEVA, ISEVA's affiliates, and each of their respective officers, directors, agents, and employees from and against any and all claims, demands, liabilities, obligations, losses, damages, penalties, fines, punitive damages, amounts in interest, expenses and disbursements of any kind and nature whatsoever (including reasonable attorneys fees) brought by a third party under any theory of legal liability arising out of or related to the actual or alleged use of Customer's services in violation of applicable law or the AUP by Customer or any person using Customer's log on information, regardless of whether such person has been authorised to use the services by Customer.
Disclaimer of Warranties
ISEVA DOES NOT WARRANT OR REPRESENT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. TO THE EXTENT PERMITTED BY APPLICABLE LAW ISEVA DISCLAIMS ANY AND ALL WARRANTIES INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE EXTENT PERMITTED BY APPLICABLE LAW, ALL SERVICES ARE PROVIDED ON AN 'AS IS' BASIS.
ISEVA shall not be in default of any obligation under the Agreement if the failure to perform the obligation is due to any event beyond ISEVA's control, including, without limitation, significant failure of a portion of the power grid, significant failure of the Internet, natural disaster, war, riot, insurrection, epidemic, strikes or other organised labor action, terrorist activity, or other events of a magnitude or type for which precautions are not generally taken in the industry.
Customer agrees to maintain a current copy of all content hosted by ISEVA notwithstanding any agreement by ISEVA to provide back up services.
Service Level Agreement (SLA)
All SLA claims must be made within 7 (seven) days of the event occurring.
We guaranteed that the our network, data centre HVAC, and power will be functioning 99.9% of the time on any given month, excluding for the following:
- Scheduled maintenance and emergency maintenance
- Server shutdown due to account suspension.
- Factors outside our control, such as force majeure events, failure of our upstream providers or your ISP.
- Software running within the servers.
- Actions of third parties, such as server compromises, denial of service attacks and viruses.
- Violations of our AUP.
- User activity errors.
